9th Circuit Court creates Constitutional Crisis.

The US Constitution names the President as Commander in Chief and solely responsible for the foreign policy of the United States. Even Congress is subordinate to the President and the Courts have NO role in decisions. 8 U.S.C. 14(f) allows the President by statute to deny entry to aliens on security grounds. The text reads:

"(f) Suspension of entry or imposition of restrictions by President

Whenever the President finds that the entry of any aliens or of any class of aliens into the United States would be detrimental to the interests of the United States, he may by proclamation, and for such period as he shall deem necessary, suspend the entry of all aliens or any class of aliens as immigrants or nonimmigrants, or impose on the entry of aliens any restrictions he may deem to be appropriate. "

 

The 9th Circuit Court is assuming authority it does not have. What happens if a refugee admitted turns out to be a terrorist? Will members of the 9th Circuit be charged as accessories to terrorism?
